We're committed to providing the industry-leading mod service that enables game developers to launch and run cross-platform UGC communities; in a safe, scalable and user-friendly manner. To uphold this commitment, we periodically update the terms and policies that govern how users and games interact with and use our service, to keep up with new mod.io functionalities, changing legal requirements and user feedback.
On the 3rd September, 2024, we rolled out an update to our policies, including our Privacy Policy, Terms of Use, Monetization Terms and other agreements incorporated by reference, that may apply to you.
Since the previous update to our terms, we've proudly launched new dashboards for creators and studios with advanced metrics, a new website for players to browse and engage with their favorite content, a marketplace toolkit for studios to reward and encourage creation, and reached the 1 billion downloads milestone. We’ve also released new documentation for developers, alongside updated Unreal, Unity and Custom Engine SDKs, which make integrating UGC discovery and consumption straightforward and highly customizable using mod.io.
As a result of some of these changes to mod.io, the different rules that apply to each platform we support, and changing privacy and platform compliance laws internationally, an overhaul of all of our agreements was needed. Our goal is to ensure our terms match the breadth and depth of what we offer today, support our future ambitions, and provide greater clarity with regards to users’ rights, how the platform works for all parties, and the rules and responsibilities that apply to each.

- The Privacy Policy has been updated with simplified wording and additional details that apply to our users.
- We have reordered the Privacy Policy, and clause 1.3 sets out a high level description of each clause that follows.
- We have added new information on the data of children and minors (clause 1.5). We will be publishing a children’s privacy rights policy separate to the main privacy policy.
- We updated the types of personal data we collect (clause 2.2).
- We clarified the legal bases on which mod.io processes personal data (clauses 3.2, 4.3, and 4.4).
- We added more detail on what type of information is publicly available (clause 8).
- We updated the categories of third party recipients of personal data (clause 9).
- We added a new clause to describe the transfer of personal data with third party payment processors (clause 10).
- We updated descriptions relating to our retention periods and security of processing your personal data (clauses 11 and 12).
- We updated descriptions of how you may raise any privacy and data protection related queries with mod.io (clause 15).

- We added an inconsistency clause (clause 1.7) to clarify which legal terms apply to you in which situations.
- We added an additional reminder about usage limits (clause 4.2).
- We added more information about what you can do in the User Control Panel, UGC Control Panel and (if applicable) Game Control Panel (clause 5.9).
- We clarified the licensing rights that apply to your UGC (clause 6.2).
- We added detail on how content is monitored on mod.io (clause 7.6, 8.3).
- We added detail on what happens to content if your account is deleted (clause 11).
- We changed the indemnity and limitation of liability clause (clause 12.2) to include Monetization Services and interactions with UGC on mod.io.
- We added additional consumer protections for Australian users (clause 16).

- Game Terms apply to you if you have submitted a Game to mod.io. We refined the wording of the licensing arrangements that apply to Game IP, user’s IP and mod.io’s IP (clauses 1, 2, 8, 9 and 12).
- We also updated clauses setting out how you may use your account (clause 3), what you need to do when using Game Services (clause 4), usage limits and maintenance details (clauses 5, 12, 13), your support obligations to End Users (clause 6), data protection and user account obligations (clauses 7 and 10), UGC moderation requirements (clause 8), and fees that may be payable (clause 11).
- We expanded the liability clauses to clarify Relevant Game Admin actions are taken on behalf of the Game studio (clause 15). Please carefully read the updated wording relating to liability (clause 15) and suspension and termination of your account (clause 16).
- If using mod.io in your game(s), you will be required to accept the changes to retain access to all functionality post the effective date.

- The Monetization Terms govern how we enable End Users, UGC Creators and UGC Resellers to interact with monetized UGC. It also allows mod.io to run competitions and other promotional activities related to monetized UGC.
- The terms received a significant update to introduce the sale and usage of virtual currency to purchase UGC.
- Refund details were moved into a separate and easily referenced format cited below.
- If using our monetization services, you will be required to accept the changes to retain access to all functionality post the effective date.
